古科技大学硕士学位论文I摘 要随着网络的发展和移动智能终端的普及,生活节奏的加快,短视频以其短小精悍的特点正好迎合用户需求,为短视频井喷式的增长创造了条件。但是,短视频作为新兴产业,在快速发展的同时侵权现象屡见不鲜。本文通过分析短视频侵权中所涉及的一系列著作权问题,为解决我国短视频侵权问题,平衡权利人与公众之间的利益,规范网络短视频市场秩序提供有效的建议。因此,本文从以下几个方面入手,对网络短视频著作权保护问题做了研究:第一部分是绪论,主要讨论短视频发展的背景及意义、文献综述、研究方法、创新点及不足,赋予研究短视频著作权保护这一论题的理论意义和现实意义。第二部分主要论述短视频著作权保护中出现的一些法律难题。短视频属于何种类型作品,能否受著作权法的保护,应受何种程度的保护,何为短视频“独创性”的认定标准,是当前著作权法及实践中备受关注的新问题。影视解说类短视频最具典型性和争议性,在我国合理使用制度规定比较固化的立法模式下,此类短视频的合法性成为认定难题。在短视频侵权中,网络平台承担着重要的角色,但是在实践中,往往平台以“通知—删除”规则即可免除责任,造成在短视频侵权案件中平台责任成为被疏漏的一环。第三部分主要对以上法律难题进行理论分析。本文中,首先,结合短视频的创作特点,从素材选择、拍摄素材的方式、后期制作方式的独创性综合判断独创性的有无及程度高低,并依据独创性的高低对短视频做出作品或制品的划分,确定其受保护的程度。其次,以影视解说类短视频为例,以使用影视片段的目的、使用影视片段的长度、对影视市场的影响为判断合理使用的标准,为短视频二次创作的合理性提供了出路。最后,从网络平台的作用和功能分析了短视频平台的直接侵权与间接侵权,在利用“通知——删除”规则无法完全明确网络平台的责任时,为了避免网络平台对注意义务的逃避,根据“红旗标准”、平台排行榜、技术措施的使用等相关事实,以理性人的视角判断网络平台的“应知”侵权的情形,确定网络平台的侵权责任。第四部分主要对短视频著作权保护的出路提出了一些建议。本文借鉴现有平台的技术手段,从建立版权制度、运用内容识别技术鉴别短视频侵权。同时利用最新的CC 许可协议满足当下的授权许可需求,为了满足当下流行的“网红效应”,构建网络著作权默示许可制度也体现出必要性。关键词:短视频;著作权;侵权;独创性;合理使用

Short video with its short and sturdycharacteristics just meets the needs of users, creating conditions for the rapid growth ofshort video. However, as a new industry, short videos are frequently infringed whiledeveloping rapidly. This article analyzes a series of copyright issues involved in shortvideo infringement, and provides effective suggestions for solving the short videoinfringement problem in China, balancing the balance between rights holders and thepublic interest, and regulating the order of the online short video market. Therefore, thisarticle starts with the following aspects to study the copyright protection of online shortvideos:The first part is the introduction, which mainly discusses the background andsignificance of short video development, literature review, research methods, innovations,and shortcomings, and gives theoretical and practical significance to the topic of protectingshort video copyright protection.The second part mainly discusses some legal difficulties in short video copyrightprotection. What kind of works does a short video belong to? Can it be protected bycopyright law? What level of protection should it be? What is the "original" recognitionstandard for short videos? This is a new issue that has attracted much attention in currentcopyright law and practice. . The short films of movie and TV commentary are the mosttypical and controversial. Under the legislative model with relatively solid regulations onfair use in China, the legitimacy of such short videos has become difficult to determine. Inthe short video infringement, the network platform plays an important role, but in practice,the platform can often be exempted from the liability with the "notification-deletion" rule,resulting in the platform liability becoming an omission in short video infringement cases.The third part mainly analyzes the above legal problems. In this article, first of all,based on the creative characteristics of short videos, comprehensively judge the existenceand degree of originality from the originality of material selection, the way of shooting

At the same time, the latest CC license agreement is usedto meet the current licensing requirements.  I摘 要随着互联网信息技术的发展,我国影视行业发展进入新媒体时代,由于移动网络成本较低,信息传播日益便捷,催生了短视频行业的兴起。因短视频作品生产流程简单、制作门槛低、参与性强等特点故其具有极高的传播价值,且成为当今主流的娱乐方式之一。在短视频如火如荼发展的今天,有关于短视频著作权的问题也日渐凸显,影响短视频的发展。短视频著作权保护的主要困境有两个,第一个是短视频的可版权性问题。短视频究竟作为作品受到著作权保护还是作为录像制品受到邻接权保护一直是争论的问题。理清短视频是否为作品,还是不构成作品的其他文化产品,是对短视频恰当保护保护的前提,也是保证短视频能获得充分版权保护的重要依据。第二个是合理使用与作品侵权的界限问题。目前短视频平台中有不少是使用他人创作过的影视作品、美术作品、音乐作品等来进行自己的短视频创作。这就涉及到使用他人的作品是否构成合理使用问题。明确合理使用标准,理清短视频制作传播中侵权与合理使用的关系,既有利于丰富我国著作权法中合理使用的内涵,也能有效规制优质作品遭受侵权现象,还能为短视频的健康发展提供保障。本文研究的主要内容是关于短视频保护的困境和对策问题,主要分为四个部分:第一部分主要通过对几个典型案例的的介绍,提出短视频行业存在的法律问题,来作为论文的切入点。第二部分主要是进行短视频的基本理论阐释,对其概念、特征、短视频的分类、发展历程和保护的必要性等方面进行回应。第三部分主要介绍短视频保护的困境,主要从两个问题进行介绍,第一个问题是介绍短视频的独创性判断存在的困境,第二个问题是介绍短视频侵权与合理使用判断中存在的困境。第四部分是对短视频的司法实践中存在困境提出相应的法律对策,重构短视频的独创性标准,完善合理使用制度,明确实质性相似的标准,使用技术手段进行版权监测,建立集体管理组织,以达到保护短视频著作权的目的。关键词:短视频;可版权性;独创性;合理使用;侵权

 IIAbstractWith the development of Internet information technology, China"s film and televisionindustry has entered the era of new media. Due to the low cost of mobile network andincreasingly convenient information transmission, the rise of short video industry has beengiven birth to. Short video has a high communication value because of its simple productionprocess, low production threshold, strong participation and other characteristics, and hasbecome one of the mainstream entertainment methods today. Nowadays, with thedevelopment of short video in full swing, the problem of short video copyright is becomingmore and more prominent, which affects the development of short video.There are two main difficulties in short video copyright. The first is the copyright issueof short video. Whether short video can be protected by copyright as a work or protected byneighboring rights as a video product has always been an issue of debate. To clarify whethershort videos are works or other cultural products that do not constitute works is a prerequisitefor proper protection of short videos and an important basis for high-quality short videos toobtain adequate copyright protection. The second is the boundary issue between fair use andinfringement. At present, many short video platforms use other people"s film and televisionworks, art works, music works, etc. to create their own short videos. This involves thequestion of whether the use of other people"s works constitutes fair use.
